Representative Herndon Introduces Safe Firearm Storage Bill

Santa Fe, N.M. - At a press conference today in front of Washington Middle School in Albuquerque, Representative Pamelya Herndon (D-Albuquerque) introduced The Bennie Hargrove Gun Safety Act to help prevent school shootings by cracking down on the improper storage of firearms. The bill is named after Bennie Hargrove, a Washington Middle School student who was fatally shot by another student using his father’s unsecured gun.

“There have been thirteen school shootings this school year, that’s thirteen too many,” said Rep. Herndon. “The Bennie Hargrove Act is about children and keeping those children safe.”

The legislation, sponsored by Rep. Herndon, along with Senator Daniel Ivey-Soto (D-Albuquerque), and co-sponsored by Representatives Debra M. Sariñana (D-Albuquerque) and Patricia Roybal Caballero (D-Albuquerque), imposes at least a $1,000 fine and a misdemeanor for adults if their improperly stored gun is brandished by a minor. If the gun is used in a fatal shooting, the adult will face a fourth degree felony charge. 

“It’s your gun, it’s your responsibility,” said Rep. Herndon.   

Ahead of the 2022 legislative session that kicks off tomorrow, House Democrats have introduced a comprehensive public safety package that will address the immediate crime crisis in the Albuquerque metro area and across New Mexico, while also making community investments to prevent crime in the long run.

In addition to holding gun owners accountable for securing their firearms, The Bennie Hargrove Gun Safety Act will expand mental health services in schools throughout the state to help any student who is struggling. 

The Roundhouse is open to the public for the session. Proof of full COVID-19 vaccination will be required to enter the building.
